We tell our clients that most cases settle before trial – and that’s true. But just because a case settles doesn’t mean there aren’t winners and losers: there are bad settlements, there are good settlements and there are great settlements. Great settlements don’t just happen – they are the result of a well-executed strategy, which begins at intake and continues to the filing of the consent dismissal order. Nothing is left to chance. To make sure your client has the best shot at a great settlement, APTLA is planning a two-conference series focused entirely on settlement of personal injury cases. You’ll learn best practices at the early stages of a case: identifying good claims; estimating and driving reserve limits; preparing an evidentiary and discovery plan; talking to adjusters; and managing your client’s expectations. Later we’ll examine when and how to initiate settlement discussions: winning demand letters; best practices for negotiation; strategies for mediation and settlement conferences; preparing your clients for settlement talks; using the rules of Court to increase chances of settlement; traps to avoid in settlement agreements; and much more. Plan to join us November 17th for the first installment of Winning Settlement Strategies & Tactics, and mark your calendars for June 15th & 16th, 2018 for the second part and conclusion to this program. Together these conferences will take your settlement game from good to great!
WINNING SETTLEMENT STRATEGIES & TACTICS, Part One will include:
• Driving Reserves: How the Colossus Algorithm affects Settlement
• Taming the Beast: Document Collection, Organization & Management
• Walking a Fine Line: Early Settlement Done Right
• Once in the Lifetime of a Case Opportunity: Preparing Your Client for Discovery
• Mining for Gold: Finding Nuggets in the Medical Records
• Social Media in Personal Injury Claims: A Case Review
