PSYCHOLOGICAL INJURIES:  CLIENTS, STRATEGIES & DAMAGES
Friday, November 15, 2013 • Delta Halifax, NS

Download the Psychological Injuries Brochure.

** This program is accredited for SEVEN (7) HOURS of MCPD by the Law Society of New Brunswick, and represents SEVEN (7) HOURS of Substantive / Skills Credits for NS and PEI Lawyers.**

Psychological Injuries bring great challenges to both victims and their counsel. These injuries are often dismissed by the insurance industry as pre-existing, over-stated or unreal. Their existence often stands in the way of both proper care and appropriate compensation. APTLA's Psychological Injuries Conference will address the challenges of representing this category of clients. It will explore the quirks and realities of the psychologically injured. We will examine Sleep Deprivation, Psychosomatic Injuries and the techniques and limits of Neuro-Psychological Testing. We will consider how and when to use  Functional Capacity Evaluations for psychologically injured clients. We will look at how to deal with Pre-Existing Conditions and the important issue of Credibility over the course of the entire file. We will consider Nervous Shock and also explore what the Courts find as "recognizable" psychiatric injuries and the applicable threshold. Finally, we will take a look at the best in Demonstrative Evidence in bringing forward these and other injury cases.

Join APTLA at Atlantic Canada’s premiere annual legal education conference for the Plaintiffs Bar being held in Halifax on Friday, November 15, 2013.

Our Halifax Conference will have excellent, skills sharpening legal education, together with an opportunity to experience the collegiality of lawyers/APTLA Members and events that are fun for all who attend.

APTLA's Psychological Injuries Conference will include:
• Representing the Psychologically Injured Client
• The Many Consequences of Sleep Deprivation
• Psychosomatic Injuries: Real Pain from Emotional Trauma
• The Pros and Cons of Psycho-Metric Testing
• Psychological & Emotional FCEs
• Demonstrative Evidence: From Physical Injury to Psychological Injury Cases

• Pre-Existing Psychological Issues or Illnesses: Getting Past the Past and Getting to Appropriate Compensation
• Pursuing the Psychological Injury Case: How to deal "Mental Health Defences" and the Defence Psychological Report
• Compensable Nervous Shock:  "Recognizable" Psychiatric Injuries & the Distinction Between Physical and Psychological Damage Thresholds

We have an excellent faculty coming together for this program. We are delighted to welcome Ava Hillier, Hillier & Hillier, to the APTLA presenter family. Ava is a co-founder of the Ontario Trial Lawyers Association, a frequent conference lecturer and Chair for many legal associations, a well respected Professor in the Trial Advocacy Course at Queen’s University, and a career plaintiff litigator. She has a wealth of experience with representing clients with psychological injuries, and brings this expertise to our program.

We welcome back Howard Richman, Grant Richman, and Dr. Barbara Ross, Psychiatrist. Howard returns to APTLA from his busy litigation practice in NYC to bring us the "Best in Demonstrative Evidence". Howard is a Member of the American Association for Justice (formerly the Trial Lawyers Association of America), a frequent lecturer for Trial Lawyer Associations across the US and Canada, and an Adjunct Associate Professor of Law, Fordham University School of Law. Dr. Ross returns to APTLA to speak about how pre-existing conditions can be distinguished from injures arising from a personal injury. Dr. Ross manages an outpatient practice for the clinical care of both adults and children, and has been conducting independent medical evaluations for over fifteen years. She has a broad experience in chronic pain and widespread pain disorders.
